EU CBAM: INTRODUCTION
WHAT IS IT?
Since October the 1st of 2023, the EUA Regulation No. 956/2023, has established a Carbon Border AdjustmentMechanism (CBAM), for emissions embedded in goods listed in Annex 1 of the Regulation at the time of theirimport into the customs territory of the European Union, . In particular, the Regulation requires importers of goodscovered by the Regulation to apply for the qualification of an authorized CBAM declarant and to comply withobligations for communication, verification, and the return of CBAM certificates through the registry established forthis purpose. The Regulation foresees a transitional period of 27 months (until December the 31st of 2025), duringwhich the importer will only have to comply with the communication obligations specified in the Regulation (withsimplification for calculation, no obligation for third-party verification, and the purchase/return of CBAM certifi for atransitional period of 27 months (until December 31, 2025), during which the importer will only have to comply withthe communication obligations specified in the Regulation (with simplification for calculation, no obligation for third-party verification, and the purchase/return of CBAM certificates).
